Terms of Service

By downloading, installing, or using NoteLark ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legal agreement between you and NoteLark. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

NoteLark is a note-taking application that provides: • Rich text note creation and editing • Voice-to-text transcription • Note organization and search • Reminder notifications • Cloud synchronization (optional) • Export functionality The App is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature at any time.

Account Creation: • You may use basic features without an account • An account is required for cloud sync features • You must provide accurate information when creating an account • You are responsible for maintaining account security Account Termination: • You may delete your account at any time • We may suspend accounts that violate these Terms • Upon deletion, your cloud data will be permanently removed

You agree to use the App only for lawful purposes. You must NOT: • Use the App to store illegal content • Attempt to gain unauthorized access to our systems • Reverse engineer or decompile the App • Use automated systems to access the App • Transmit viruses or malicious code • Violate intellectual property rights • Harass, abuse, or harm others • Impersonate any person or entity

Ownership: • You retain ownership of all notes and content you create • We do not claim any ownership rights to your content License Grant: • You grant us a limited license to store and process your content solely to provide the service • This license terminates when you delete your content or account Responsibility: • You are solely responsible for your content • We do not monitor or review user content • We may remove content that violates these Terms

Free Tier: • Basic note-taking features are free • Limited voice-to-text uses per account Premium Features: • Unlimited voice transcription requires a premium subscription • Subscription fees are non-refundable except as required by law • Prices may change with notice In-App Purchases: • All purchases are processed through the App Store/Play Store • Their terms and refund policies apply

App Ownership: • The App, including all code, design, and content, is owned by NoteLark • All trademarks, logos, and service marks are our property Restrictions: • You may not copy, modify, or distribute the App • You may not create derivative works • You may not remove any proprietary notices

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including: • Merchantability • Fitness for a particular purpose • Non-infringement • Accuracy or reliability of content • Uninterrupted or error-free service We do not guarantee that: • The App will meet your requirements • The App will be available at all times • Your data will never be lost

TO THE MAXIMUM EXTENT PERMITTED BY LAW: • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages • Our total liability shall not exceed the amount you paid us in the past 12 months • This limitation applies regardless of the legal theory This includes but is not limited to: • Loss of data • Loss of profits • Business interruption • Personal injury

You agree to indemnify and hold harmless NoteLark and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from: • Your use of the App • Your violation of these Terms • Your violation of any rights of another party • Your content

Termination by You: • You may stop using the App at any time • You may delete your account through settings Termination by Us: • We may terminate or suspend your access immediately, without notice, for any reason • Upon termination, your right to use the App ceases immediately Survival: • Sections regarding intellectual property, disclaimers, and limitations of liability survive termination

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits against us.
